Tobacco Regulation in the Kingdom of Quinta Velha.
Recognizing the harmful health effects associated with tobacco use and the need to protect the well-being of citizens, this decree aims to regulate the production, distribution, sale and use of tobacco products within the Kingdom of Quinta Velha. By enacting this legislation, Quinta Velha seeks to promote public health, reduce tobacco-related harm and create a comprehensive framework for responsible tobacco consumption.
"Tobacco products" refers to any products derived from the tobacco plant (Nicotiana tabacum) intended for smoking, chewing or other forms of consumption.
"Retailer" refers to any individual or entity involved in the sale of tobacco products to consumers.
The production, distribution, sale and use of tobacco products within the boundaries of Quinta Velha must be regulated in accordance with the provisions set out in this bill.
The Ministry of State for Home Affairs must oversee and enforce tobacco-related regulations.
All tobacco products must display prominent health warnings on the package detailing the risks associated with tobacco use.
The packaging must not contain misleading information, designs or images that could attract minors or misrepresent potential health risks.
Advertising, promotion and sponsorship of tobacco products must be strictly regulated to avoid targeting minors and provide accurate risk information.
Tobacco advertising should not be allowed in places accessible to minors, including schools, playgrounds and public transport.
The legal age to purchase and use tobacco products must be 21 years old.
Retailers will be required to verify the age of customers before selling tobacco products.
Retailers must obtain a license from the Ministry of State for Home Affairs to sell tobacco products and adhere to regulations regarding sales, advertising and age verification.
Retailers must not sell tobacco products to individuals under the legal age and must actively discourage underage tobacco use.
Smoking should be prohibited in enclosed public spaces, workplaces and areas where minors gather.
Designated smoking areas may be established in certain outdoor spaces, subject to local regulations.
An excise tax will be levied on the sale of tobacco products, with proceeds going towards health, education and smoking cessation programs.
Income generated by tobacco-related activities should be used to raise awareness of the harms of tobacco use and provide support to individuals trying to quit smoking.
The Ministry of State for Home Affairs, in collaboration with law enforcement agencies, must enforce tobacco regulations.
Penalties for violating tobacco regulations must be proportionate and may include fines, license suspension and public service.
This decree will come into force from the date of its publication.
The Ministry of State for Home Affairs must be established within 60 days from the effective date to develop regulations and oversight mechanisms.
This bill will be reviewed 90 days after its implementation to assess its impact on public health, compliance and other relevant factors.
Based on the review, amendments may be proposed to increase the effectiveness of tobacco regulation.
By enacting this decree, Quinta Velha aims to create a comprehensive regulatory framework that promotes public health, discourages tobacco use among minors, and raises awareness of the risks associated with tobacco use.
