Recognizing changing global attitudes towards cannabis and its potential benefits for medical, economic and social purposes, this decree aims to legalize and regulate the cultivation, distribution, sale and use of cannabis in the Kingdom of Quinta Velha. By enacting this legislation, Quinta Velha seeks to ensure responsible consumption, generate revenue, promote public health and eliminate unnecessary criminalization of individuals involved in non-harmful cannabis-related activities.
The cultivation, possession, sale, distribution and use of cannabis by adults within the boundaries of Quinta Velha must be legalized and regulated in accordance with the provisions of this decree.
All cannabis-related activities must be subject to the regulations and supervision of the Ministry of State for Home Affairs and the Cannabis Regulation Service of the Kingdom of Quinta Velha.
The cultivation of cannabis in the territories of the Kingdom of Quinta Velha is prohibited.
The crime of illegal cultivation of cannabis in the Kingdom of Quinta Velha will be punished in accordance with current legislation.
The sale of cannabis in the territories of the Kingdom of Quinta Velha is prohibited, under penalty of administrative and criminal proceedings in accordance with the national legislation of the Kingdom.
It is illegal, in Quinta Velha, to give cannabis to anyone under 21 (twenty-one) years old, under penalty of administrative and criminal proceedings in accordance with the national legislation of the Kingdom.
Any national or foreigner who tries to enter national physical territories carrying cannabis will be submitted to the necessary procedures for regulating the substance.
The Royal Foreigners and Borders Service (RESEF) will provide a form where the bearer must declare the origin of the cannabis, as well as enter their personal data for identification in the national public security systems.
The holder of cannabis, after identifying and declaring the origin of the substance, must pay a fee in the amount of £75.00 (seventy-five lines) to issue a certificate of legalization of the substance in the territories of Quinta Velha.
The amount of 15 (fifteen) grams per person is set as the limit for entering national territories carrying cannabis.
All nationals and foreigners who enter the physical territories of Quinta Velha will undergo security inspection procedures, to be carried out by RESEF agents with the support of the military and police forces of the Kingdom of Quinta Velha. If a quantity exceeds that stipulated in the legislation, the surplus will be collected immediately and a fine of £35.00 (thirty-five lines) will be added to the legalization fee.
All territories of the Kingdom must have their own environment for the consumption of cannabis, preferably always outdoors. Consumption of cannabis outside these locations is illegal in Quinta Velha.
Once the crime of consuming cannabis in an inappropriate place is proven, the author will be prosecuted administratively and will pay a minimum fine of £202.00 (two hundred and two lines), the amount being progressive depending on the particularities of each case.
Places reserved for cannabis use will be signposted for this purpose.
All revenue collected through the consumption of cannabis will be allocated to public health programs, education and substance abuse prevention efforts.
Income generated by cannabis-related activities is to be used to fund research into the medical, economic and social impacts of cannabis in the Kingdom of Quinta Velha.
The Cannabis Regulatory Service of Quinta Velha should collaborate with relevant agencies to implement educational campaigns on the responsible use of cannabis, potential risks and harm reduction strategies.
Support should be provided to individuals seeking treatment for cannabis-related substance use disorders.
The Cannabis Regulatory Service of the Kingdom of Quinta Velha and law enforcement agencies must collaborate to enforce cannabis regulations.
Penalties for violating cannabis regulations must be proportionate and can include fines, mandatory education and community service.
This decree will enter into force on the date of its publication.
The Cannabis Regulatory Service of the Kingdom of Quinta Velha shall have until the first of September, two thousand and twenty-three from the effective date to establish the necessary regulations, licensing procedures and supervision mechanisms.
This decree will be subject to review 90 days after its implementation to assess its impact on public health, revenue generation and other relevant factors.
Based on the review, necessary changes can be proposed to increase the effectiveness of cannabis regulation.
